Terms and Conditions

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Cooling-off period: the period during which the consumer may exercise their right of withdrawal.

Consumer: the natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with the entrepreneur.

Day: calendar day.

Ongoing transaction: a distance contract relating to a series of products and/or services, whereby the delivery and/or purchase obligation is spread over time.

Durable data carrier: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information.

Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period.

Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance.

Distance contract: a contract whereby, within the framework of a system organized by the entrepreneur for the remote sale of products and/or services, exclusive use is made of one or more techniques for distance communication up to and including the conclusion of the contract.

Technique for distance communication: a means that can be used for concluding a contract, without the consumer and entrepreneur being simultaneously present in the same place.

General Terms and Conditions: these General Terms and Conditions of the entrepreneur.


Article 2 – Applicability

These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.

Before the distance contract is concluded, the text of these general terms and conditions shall be made available to the consumer. If this is not reasonably possible, it will be indicated before the distance contract is concluded that the general terms and conditions can be inspected at the entrepreneur’s premises and will be sent to the consumer free of charge upon request as soon as possible.

If the distance contract is concluded electronically, then, in deviation from the previous paragraph and before the contract is concluded, the text of these general terms and conditions may be made available electronically in such a way that the consumer can easily store them on a durable data carrier. If this is not reasonably possible, it will be indicated where the general terms and conditions can be consulted electronically and that they will be sent free of charge upon request.

If specific product or service conditions also apply in addition to these general terms and conditions, the second and third paragraphs shall apply accordingly, and in the event of conflicting conditions, the consumer may always rely on the provision that is most favorable to them.

If one or more provisions of these general terms and conditions are at any time wholly or partially null and void or annulled, the agreement and these conditions shall otherwise remain in force, and the provision concerned shall be replaced by mutual agreement with a provision that most closely approximates the original intent.

Situations not covered by these general terms and conditions shall be assessed in accordance with the spirit of these terms and conditions.

Any ambiguities regarding the interpretation or content of one or more provisions shall be interpreted in accordance with the spirit of these general terms and conditions.


Article 3 – The Offer

If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.

The offer is non-binding. The entrepreneur is entitled to modify and adjust the offer.

The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable the consumer to properly assess the offer. If images are used, they are a truthful representation of the products and/or services. Obvious errors or mistakes in the offer do not bind the entrepreneur.

All images, specifications, and data in the offer are indicative and cannot give rise to compensation or dissolution of the agreement.

Images of products are a truthful representation of the products offered. The entrepreneur cannot guarantee that the displayed colors exactly match the actual colors of the products.

Each offer contains sufficient information to make it clear to the consumer what rights and obligations are attached to acceptance of the offer, including in particular:

  • the price including taxes;

  • any shipping costs;

  • the manner in which the agreement will be concluded and what actions are required;

  • whether the right of withdrawal applies;

  • the method of payment, delivery, and performance of the agreement;

  • the period for accepting the offer or the period during which the price is guaranteed;

  • the rate for distance communication if costs differ from the regular base rate;

  • whether the agreement will be archived and how it can be accessed;

  • how the consumer can check and correct their data before concluding the agreement;

  • any other languages in which the agreement may be concluded besides Dutch;

  • the codes of conduct to which the entrepreneur is subject and how they can be consulted electronically;

  • the minimum duration of the distance contract in the case of an ongoing transaction.

Optional: available sizes, colors, types of materials.


Article 4 – The Agreement

The agreement is concluded, subject to the provisions of paragraph 4, at the moment the consumer accepts the offer and meets the conditions set.

If the consumer accepts the offer electronically, the entrepreneur will promptly confirm receipt electronically. As long as receipt of acceptance has not been confirmed, the consumer may dissolve the agreement.

If the agreement is concluded electronically, the entrepreneur will take appropriate technical and organizational measures to secure electronic data transmission and ensure a safe web environment. If the consumer can pay electronically, appropriate security measures will be taken.

The entrepreneur may, within legal limits, investigate whether the consumer can meet their payment obligations and consider relevant facts and factors. If there are good reasons not to conclude the agreement, the entrepreneur may refuse or impose special conditions.

The entrepreneur will provide the consumer with the following information in writing or in a durable format:

a. the visiting address for complaints;
b. the conditions and method of exercising the right of withdrawal, or notice if excluded;
c. information about guarantees and after-sales service;
d. the information listed in Article 4(3), unless already provided;
e. termination requirements for agreements longer than one year or indefinite duration.

In the case of ongoing transactions, this applies only to the first delivery.

All agreements are concluded subject to sufficient product availability.


Article 5 – Right of Withdrawal

Upon purchase of products, the consumer has the right to dissolve the agreement without giving reasons within 14 days. The cooling-off period starts the day after receipt of the product.

During this period, the consumer must handle the product and packaging with care and only unpack or use it to the extent necessary to assess the product.

To exercise the right of withdrawal, the consumer must notify the entrepreneur in writing or by email within 14 days of receipt and return the product within 14 days thereafter. Proof of timely return must be provided.

If the consumer does not notify or return the product in time, the purchase becomes final.


Article 6 – Costs in Case of Withdrawal

If the consumer exercises the right of withdrawal, return shipping costs are borne by the consumer.

Any payments made will be refunded within 14 days after withdrawal, provided the product has been received or proof of return has been supplied.


Article 7 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for products:

a. made to the consumer’s specifications;
b. clearly personalized;
c. not suitable for return;
d. perishable or short-lived;
e. subject to market price fluctuations;
f. newspapers and magazines;
g. sealed audio/video recordings or software once unsealed;
h. sealed hygiene products once unsealed.

And for services:

a. accommodation, transport, catering, or leisure services for a specific date;
b. services begun with consumer consent before the cooling-off period ends;
c. betting and lotteries.


Article 8 – The Price

Prices remain unchanged during the validity period except for VAT changes.

Variable pricing may apply for products subject to market fluctuations.

Prices include VAT.

Typographical errors are not binding.


Article 9 – Conformity and Warranty

Products and services must comply with the agreement, specifications, and legal standards.

Manufacturer warranties do not affect consumer statutory rights.

Defects must be reported within 14 days of delivery.

Warranty does not apply in cases of misuse, repairs by unauthorized parties, or improper handling.


Article 10 – Delivery and Execution

Orders are delivered within 30 days unless otherwise agreed.

Delays will be communicated, and the consumer may cancel and receive a refund.

The risk of loss or damage passes to the consumer upon delivery.


Article 11 – Ongoing Transactions: Duration, Termination, and Renewal

Consumers may terminate indefinite contracts at any time with one month’s notice.

Fixed-term contracts may be terminated at the end of the term.

Automatic renewal is limited and regulated.


Article 12 – Payment

Payments must be made within 7 working days.

Incorrect payment details must be reported immediately.

Late payments may incur reasonable costs.


Article 13 – Complaints Procedure

Complaints must be submitted within 7 days of discovery.

Responses will be given within 14 days.

Unresolved disputes are subject to dispute resolution procedures.


Article 14 – Disputes

All agreements are governed exclusively by Dutch law, even if the consumer resides abroad.
